Custom Designs Terms of Service

To keep our business running smoothly and ensure we keep a good schedule and time frame for all custom design clients, we must impose terms to our custom design quotes. Please be sure to read, understand, and/or ask questions regarding these terms before making your purchase.

The Quote

Once you have requested a quote via telephone or our contact form, we’ll guarantee the accuracy of our quote for the next 30 days. If your project details remain the same, so does our price. However, adding or removing details of your project may change the price of the quote you were given.

To prevent price changes in the first 30 days of your quote be sure to provide all details for your project, any add-ons you want, additional banners, etc. Having this information allows us to give you the correct price, every time.

After your 30 day quote grace period, you will need to request a new quote.

Payment

All designs from Kiss My Code must be paid through PayPal. Once we have received a partial or full payment (depending on terms of our agreement with you) for your custom design, we’ll begin working on your project on the date previously discussed. Understand that once you have paid Kiss My Code for development and design, there are no refunds, no exceptions.

Information

Should we require further information and/or data from you to complete your site you will have the list of required information within 24 hours of the start of your project. Of course, as projects progress there may be an occasion where we will need further information and/or clarification from you to complete your design. Should unexpected circumstances arise that require further information from you, we ask that you take no more than 3 days to provide us with the requested information during the development of your site.

Development & Design

We ask a lot of questions when you are requesting your quote. This is to ensure that from the start we understand what you are after with your project. It also helps us to understand the amount of time your design will require, what your needs are, and how to charge you a fair amount for the time and/or design.

Because of the amount of detail we request, each custom design is only given 2 rounds of revisions. These revisions come with your first look at the site, when revisions are specifically requested and at the end of your first round of completed revisions when we request final tweaks and modifications to your requested revisions. If you request that we do more than these 2 rounds of revisions, you will be charged per additional revision.

Schedules & Time

Your quote is provided with full information on the price, complete work list, and time frame for completed work. If we tell you that your project will take a week, as long as you do not hang us up or change the project, your project will only take a week.

If you stall, prevent, or otherwise hinder our ability to complete your project in the time from we have discussed we will move on to our next project and put your project on the hold until you have provided what was needed to finish your design.

Failure to Provide Information

Some projects will require extensive time on our part and we are willing to give you the time for the agreed upon rate for your project. If we request data and/or information to complete your design and you fail to provide this information it could put your project at risk. As previously mentioned, your site will be placed on hold if you fail to deliver required information.

If the lack of information and/or data hinders our ability to complete your design you may forfeit your rights to your custom design. We will keep your web project a priority for 30 days. After 30 days should you provide requested information, we will finish your project as quickly as possible. If after 45 days you have failed to provide requested information you will forfeit all rights to your custom project/design and will not be issued a refund. To continue to your project after the 45 day grace period, we may impose a fee up to 250% of the original cost of your project. Futhermore, we reserve the right to not resume your project if you have failed to provide information within the 45 day grace period.

Communication

For larger projects we find that our clients like to clarify and brainstorm about their projects via telephone and we’re happy to comply. However, extensive telephone conversations cost us time and therefore, after more than 2 hours of telephone conversation regarding your design you will be billed at the hourly rate of $45.00 USD.

Furthermore, to keep us and clients on the same page, if our phone conversation with you changes the course of your project, we will send you a recap of our conversation. You must approve these changes in writing before we will continue design and development. This will ensure that all of us remain on the same page and your project is completed to your highest expectations.

Special Circumstances

Should you find yourself in a jam during the course of your custom project, please talk to us. We’re always willing to make exceptions if we understand the circumstances you face. Please understand that our terms are simply meant to keep us on our schedule while providing each client the highest quality experience and design as possible.
